Noobstown court
« on: 25 Sep 2012, 00:22:34 »
I have recently tried to stand for justice against The Kingdom of Seaside to which was met by injustice  :'(. As a result of this I have decided to propose a noobstown court in which justice will be served, which i shall be the judge. If you support this please post your support on the forum.
Sincerely,
Bakerzilla

Seaside is deeply sorry for all your troubles, and want to grant your wish to pay our debt.

We will build the court, - in Seaside. Debo will, on free will just for you, be the judge of the court.

All of Seaside is looking forward seeing you in court in multiple cases where you sue the Extreme Hills for being too extreme, lava for being too hot, Skeletons for being to skinny, and Raiden 600 for melonizing you without you approving it.

Hope this will help you move on with your traumatic experience.

Before you take this any further you might want to consider some basic principles of "justice".
1. How are you planning to force people to obey your warrants?
2. Who has appointed you judge? There has to be a reason people should recognize a judges authority.
3. How big will the panel of judges be? A jury of one is not sufficient to ensure impartiality.
4. Under which laws and regulations will "justice" be defined? A judge can only serve a certain structure of laws and not his own personal opinion of what justice is. So you'd basically have to write a constitution first before you can think of establishing a system of justice.
5. On which kind of justice will it be based (i.e. in many countries a panel of judges decides the verdict, not a Jury; in others a jury is appointed).
6. What higher authority will there be to decide if the sentenced party is appealing the verdict? Who ensures that the powers of a judge can not be abused (for example for personal revenge)?

You might also want to think about the most important question if this shouldn't be left to the Mods (and as higher instance the admins watching over the mods decisions) and the serverrules.

I plan to have a jury with a head judge.
I have appointed me to be judge, as an emperor must do with a newly formed country i must do this for the court
I plan to have a fair court and deliver justice

That answers partly point 2 & 5, but not the rest.

Point 2:
Judges and courts simply do not appoint themselfes (if emperors do that it is called "seizure of power"; which is nothing a judge should ever try to achieve). The appointment of a court or judge by a higher authority is the one thing that give them the authority to make verdicts; without such an authority there would be no reason for anyone to even care about the judges verdicts (see point 1).
So this only broadens the theoretical questions behind point 2:
2a. How does a selfappointed judge get all people on the server to accept his authority (including towns and mayors)?
2b. How is the community protected from a selfappointed judge turning to despotism? Personal guaratees and promises are NOT a good enough security to ensure the people' s rights.

"Delievering justice" is not just a fancy phrase. It needs to be really understood so it can be used for good- it needs laws so the court can not just pass out verdicts after its own taste. The court has to enforce the law, not making their own verdicts by themselfes, but by exactly following the laws.
A court can not be above the law unless it also holds the governmental power - which would turn the judge into a leader (like a king or despot), which is certainly not acceptable for all the towns out there as it would be an usurpation of power (and I can assure you that no one in DragonFire will ever follow a higher leader than Twisted, (except for the pantheon of admins - maybe - if her grace allows it).

So if you want real support from players like me, you would have to show that there is more behind all this than the promise "I plan to have a fair court and deliver justice". You would have to show that you actually understand what a system of Justice and a constitution are all about. You' d have to create failsafe mechanisms to prevent this authority from ever been used injustly or to gain power. And you'd have to convince as that this is not just about your problems with Seaside.

Decisions like these are made by the Staff team, therefore this idea will not go ahead.

Some issues I have with this...
1. Judges don't appoint themselves..
2. You are in no such position to appoint yourself as head of anything to do with "justice" in Noobstown.
3. This "Court" will just cause useless whining.
4. You can't force other players to obey you, either.
    Just what I think...

I humbly nominate myself for the position of Chief Justice.  What could possibly go wrong?  O:)

Why would you resurrect a topic that's already over?
